Directorate General of Foreign Trade, Ministry of Commerce & Industry had issued a Notification No.58/2009-14 dated 17.08.2010, whereby all export contract for export of raw cotton (Tariff Item Code 5201), cotton waste (Tariff Item Code 5202) and cotton, carded or combed (Tariff Item Code 5203) are subject to the Export Authorization Registration Certificate (EARC) procedure with the Textile Commissioner, Mumbai. The export contracts must be registered prior to shipment.
This Notification shall come into effect from 1.10.2010.
Accordingly, the Textile Commissioner shall commence registration of export contract for the above items w.e.f., 15.09.2010. The Textile Commissioner has issued a Memorandum-I(copy enclosed) prescribing the terms and conditions for EARC in respect of raw cotton, cotton waste and cotton, carded or combed. All exporters shall have to register their export contracts in respect of raw cotton, cotton waste and cotton, carded or combed prior to shipment with the Textile Commissioner, Government of India, Mumbai.

MEMORANDUM-I
Sub: Procedural requirement for obtaining Export Authorisation Registration of raw cotton (lint), cotton waste (including yarn
waste and garnetted stock), cotton, carded or combed, with the Textile Commissioner, Mumbai, prior to shipment in terms
of Notification No.58/2009-14 dated 17.8.2010 of Directorate General of Foreign Trade, Ministry of Commerce and Industry,
issued under the Foreign Trade Policy 2009-2014.
1. As per ITC Code No.5201, 5202 and 5203 of Chapter 52 of the ITC (HS) Classification of Export & Import Items, 27th August, 2009 - 31st March, 2014 issued
under the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) by the Directorate General of Foreign Trade, Government of India, New Delhi, raw
cotton (lint), cotton waste (including yarn waste and garnetted stock), cotton, carded or combed, can be exported only against valid Export Authorization Registration
Certificate for shipment issued in this regard by the Textile Commissioner, Mumbai. The detailed guidelines for such Export Authorisation Registration are issued
hereunder accordingly. Every person/firm/unit/ corporation/company desirous of exporting raw cotton (lint), cotton waste (including yarn waste and garnetted stock)
and cotton, carded or combed is required to fulfill these terms and conditions.
2. The application for obtaining Export Authorisation Registration Certificate (EARC), in the prescribed form as at Annexure- I‘A’ (Raw cotton - Lint), I‘B’ (cotton
waste) & I‘C’ (cotton, carded or combed) as per applicability, may be submitted to the Office of the Textile Commissioner, Nishtha Bhavan (New C.G.O. Bldg.), 48,
Vithaldas Thakarsee Marg, Post Bag No.11500, Churchgate, Mumbai-400 020, only through the online system now introduced by the office of the Textile Commissioner.
However, in case of any unforeseen circumstances leading to online system failure, then with the permission of the Textile Commissioner, the application for registration
of export contract will be done manually in which case application would be submitted to the Receipt and Issue Section of Office of the Textile Commissioner,
Nishtha Bhavan (New C.G.O. Bldg.), 48, Vithaldas Thakarsee Marg, Post Bag No.11500, Churchgate, Mumbai-400 020 on all working days upto 4.00P.M.
Separate Press Note and Guidelines for online filing of EARC request (Application) on web based system is issued in this regard and the same is available on the
Website www.txcindia.gov.in, under the heading “Cotton” and link “Guidelines for online filing of application for registration of export”.
3. Procedure for submission of application The applicant should submit the Export Authorization Registration Form (Annexure- I‘A’, I‘B’ & I‘C’ as the case may be) as per detailed instructions contained in this Memorandum along with the following documents: The scanned image of all pages of the Export contract and depending upon the terms of payment, copies of the following documents:

On being satisfied that the information furnished in Annexure- I‘A’, I‘B’ & I‘C’, as the case may be, is duly completed in all respects, the Textile Commissioner or his authorized officers (Joint Textile Commissioner/ Director/ Deputy Director/Assistant Director) shall issue Export Authorisation Registration Certificate in prescribed form as at Annexure-II with a validity of shipment period of 45 days. The Export Authorisation Registration Certificate (Annexure-II) duly signed with the Government seal will be issued to the applicant for submission to customs authority prior to shipment.
4. Terms and Conditions for Export Authorization Registration:
(i) The Export Authorisation Registration Application alongwith a copy of the export contract to be registered should be submitted within 45 days prior to the date of actual shipment. The export contract should be duly signed by both the exporter and importer.
(ii) The shipment period would be restricted to 45 days from the date of issue of the EARC irrespective of the shipment period indicated in the export contract copy.
(iii) The application complete in all respects and filled in prescribed format will only be considered for issue of EARC.
(iv) In case, the exporter has not shipped the registered quantity within stipulated period of 45 days, and is desirous to get extension in shipment period beyond 45 days, then the exporter may submit his request with the justification for necessary revision in extension of shipment period. If the export is not performed within the stipulated period, then the EARC issued would stand lapsed.
(v) If due to some reason, the Export Contract is cancelled (by importer / exporter) or export is not effected , the exporter shall inform the Textile Commissioner of such cancellation / non-exportation within 21 days from the date of cancellation. If an exporter does not inform the Textile Commissioner about the cancellation of Export Contract/nonexportation against the Export Contract registered earlier, then no further application for the Export Contract to be registered will be entertained.
(vi) After the actual export of quantity, the exporter shall enter the details of the shipment effected through the online system introduced by the office of the Textile Commissioner and as indicated in the Press Note and Guidelines for Submission of shipment documents issued in this regard. Simultaneously, the exporter shall also submit physically legible exchange control copy of shipping bills as issued by the Customs alongwith the copy of the EARC with the Customs’ shipment endorsement, copy of commercial invoice and details mentioned in prescribed Annexure-III, within 21 days from the date of actual shipment.
(vii) If an exporter does not submit the proof of shipment details against the shipment made related to the earlier Export Contract registered, within the prescribed 21 days period from the date of expiry of permitted shipment period, then, the exporter’s further application for registration of export contract will not be entertained till such a time the aforesaid proof of shipment details and documents are submitted.
(viii) Standard weight of a raw cotton bales should be 170 kg. Tolerance of +10kg will be allowed in the standard weight of each bale, as per Bureau of Indian Standards (BIS) Specification Number IS 12171:1999 Indian Standard, COTTON BALES – SPECIFICATION (First Revision), as amended. The un-shipped quantity beyond the said tolerance limit would be considered as non shipment / partial non-shipment.
(ix) If after issue of EARC, it is found that it was obtained/ altered by misrepresenting facts by fraudulent means the same will be cancelled by the office with immediate effect and the said exporter will be debarred from fresh registration for six months. Suitable action under the law of land may also be initiated against such exporter.
5. The applicants opting for hand delivery may collect their Export Authorisation Registration Certificate (EARC) documents in person or by another person against a letter of authorization from the applicant between 2.30 PM to 6.00 PM on all working days from Receipt and Issue Section of office of the Textile Commissioner, Nishtha Bhavan (New C.G.O. Bldg.), 48, Vithaldas Thakarsee Marg, Post Bag No.11500, Churchgate, Mumbai-400 020. Such person receiving the document in person should give their acknowledgement in the Register separately maintained. In case of applicants opting for receipt of EARC by post, those documents will be dispatched by Registered Post/Speed Post.
